The Superintendent of Insurance of New York State has told us that the reduction in time frames for submitting claims will allow insurers to monitor claims from the beginning of treatment; insurers will be able to analyze, evaluate and verify the legitimacy of costs; insurers will be able to detect and investigate claims that may raise a suspicion of fraud in a more timely manner; the revisions should result in lower claims costs by eliminating the need for immediate independent medical examinations, peer reviews and special investigations which should further result in a reduction in the number of matters requiring litigation.

The changed time frames are:

Events Prior Deadline New Deadline
Insured’s Notice of Claim 90 days after the accident 30 days after the accident
Proof of Claim for Medical Expenses 180 days after service is rendered 45 days after service is rendered
Proof of Claim for Work Loss NONE 90 days after the work loss is incurred

Insurance agents and insurance brokers who wish to decrease their E&O exposure should notify insureds of these shortened time frames.

Personal Auto Insurance

Does your insurance company guarantee Original Equipment Manufactured (OEM) parts if your car is involved in an accident?

1- If your company tries to use after market parts then fight for OEM parts, or;

2- you can choose a company that does use OEM parts

Consumers Union says to get it upfront and in writing that you are entitled to OEM pieces for your car after an accident. Shop and compare insurance companies.

CU also advises to carefully consider your decision before using aftermarket parts and,  while it’s in the interest of the consumer to use less expensive parts – on a quality par with OEM parts – there is  no guarantee that what you get will be of that quality.  Don’t give up your rights, Consumers Union advises. In a Consumers Union survey, 71 percent of those people who insisted on OEM parts got approval for those parts from their insurers. Remember, the real truth of the matter is that If you don’t ask for what you want, you can’t get it.

And when you are in need of used parts, which are hard to find sometimes, recycling yards offer good value, and it makes environmental sense to patronize them.
